These Website Terms and Conditions govern your access to and use of the Galleria Women's Health website and online services. They are separate from, and in addition to, the Privacy Policy, Notice of Privacy Practices, and Patient Policies & Practice Agreement. Those separate documents may apply depending on the nature of your interaction with the practice.

1. Acceptance of Terms

These Website Terms and Conditions (the "Terms") govern access to and use of the website located at galleriawomenshealth.com, together with any online forms, appointment request features, patient resource pages, digital content, and related online services made available through the website (collectively, the "Site"). The Site is operated by Deepali Kashyap MD PLLC, doing business as Galleria Women's Health ("Galleria Women's Health," the "practice," "we," "us," or "our").

By accessing or using the Site, submitting information through an online form, requesting an appointment, using a booking link, accessing patient resources, or otherwise interacting with the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use the Site.

If you access or use the Site on behalf of another person, including a minor, you represent that you have legal authority to do so and that you agree to these Terms on that person's behalf, except where applicable law permits the individual to act independently.

2. Definitions

For purposes of these Terms, "Site" means the website located at galleriawomenshealth.com and any related webpages, online forms, booking links, digital resources, and online features controlled by the practice. "Content" means all text, graphics, images, logos, videos, articles, blog posts, FAQs, service descriptions, downloadable resources, and other materials available on the Site. "User," "you," or "your" means any person who accesses or uses the Site. "Patient" means an individual who has been evaluated by a provider of Galleria Women's Health and for whom the provider has agreed to provide care.

3. Practice Information and Scope of Website

Galleria Women's Health is a women's healthcare practice located in Henderson, Nevada. The practice provides gynecologic care, menopause care, hormone health services, sexual wellness care, functional medicine services, adolescent gynecology, preventive women's health services, and related medical services.

The Site is intended to provide general information about the practice, its services, patient resources, appointment request options, and educational health-related content. Information published on the Site may not always reflect the most current availability, pricing, insurance participation, provider schedule, services, or operational requirements. The practice may modify, suspend, discontinue, or update any service, program, content, form, or online feature at any time without prior notice.

4. Relationship to Other Practice Documents

These Terms govern website access and online interactions only. They do not replace, modify, or supersede any separate agreement, policy, consent, or notice that applies to patients or prospective patients.

The Privacy Policy governs website-related privacy matters, including online forms, cookies, analytics, communications, and general online data practices. The Notice of Privacy Practices governs the use and disclosure of protected health information under HIPAA and applicable privacy laws. The Patient Policies & Practice Agreement governs patient obligations, appointment policies, cancellation and no-show rules, insurance and payment responsibilities, prescription refill policies, telehealth requirements, medical records procedures, communication expectations, program-specific requirements, and patient conduct standards.

If any provision of these Terms conflicts with a signed patient agreement, written consent, financial agreement, Notice of Privacy Practices, Privacy Policy, or Patient Policies & Practice Agreement, the more specific document shall control with respect to the applicable subject matter.

5. No Medical Advice

The Content on this Site is provided for general educational and informational purposes only. It is not intended to constitute medical advice, diagnosis, treatment, or a substitute for professional healthcare evaluation.

The Site may contain information regarding gynecology, menopause, perimenopause, postmenopause, hormone therapy, functional medicine, sexual wellness, metabolic health, adolescent gynecology, preventive care, and related medical topics. Such information is general in nature and may not apply to any specific individual, symptom, diagnosis, condition, medication, treatment plan, risk factor, or medical history.

No person should disregard professional medical advice, delay seeking medical care, begin or discontinue medication, change a treatment plan, or make healthcare decisions solely because of information found on the Site. Medical care must be based on an individualized evaluation by a qualified healthcare provider, including consideration of medical history, symptoms, examination when appropriate, laboratory testing when appropriate, risk factors, contraindications, current medications, allergies, and professional clinical judgment.

6. No Provider-Patient Relationship

Use of the Site does not create a physician-patient, provider-patient, or healthcare professional-patient relationship between you and Galleria Women's Health, Deepali Kashyap MD PLLC, any provider, or any member of the practice team.

A provider-patient relationship is not created by reading Content, submitting a contact form, requesting an appointment, calling the office, sending an email, using a booking link, viewing educational materials, following social media content, downloading resources, or otherwise interacting with online services.

A provider-patient relationship begins only after a patient has been evaluated by a healthcare provider of Galleria Women's Health and that provider agrees to provide care. Until such relationship is established, the practice has no obligation to provide diagnosis, treatment, prescriptions, refills, referrals, test interpretation, emergency assistance, or follow-up care through the Site.

7. Emergencies and Urgent Medical Matters

The Site is not intended for emergency use and is not monitored continuously. Website forms, email, voicemail, social media, appointment request tools, and patient portal messages must not be used for medical emergencies or urgent medical situations.

If you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency department. Emergency or urgent symptoms may include severe pain, heavy bleeding, chest pain, difficulty breathing, fainting, symptoms of stroke, severe allergic reaction, severe infection symptoms, thoughts of self-harm, or any condition that may require immediate medical attention.

Galleria Women's Health does not guarantee immediate review of website submissions, emails, portal messages, voicemails, or appointment requests. Delays in using the appropriate emergency medical system may result in serious harm.

8. Appointment Requests and Scheduling

The Site may permit patients or prospective patients to request appointments through online forms, booking links, or third-party scheduling systems. Submission of an appointment request does not guarantee that an appointment has been accepted or confirmed.

An appointment is confirmed only when Galleria Women's Health or an authorized scheduling system confirms the appointment date and time. The practice reserves the right to accept, deny, cancel, or reschedule appointment requests based on provider availability, clinical appropriateness, patient status, insurance participation, required documentation, outstanding balances, incomplete registration, or other practice policies.

New patients may be required to complete registration forms, medical history forms, insurance information, acknowledgments, consents, and financial agreements before receiving care. Walk-in appointments are not accepted. Same-day appointments may be limited and are generally reserved for urgent gynecologic concerns when scheduling permits.

9. Cancellations, No-Shows, and Late Arrivals

Patients are expected to keep scheduled appointments or provide timely notice if cancellation or rescheduling is necessary. Appointments require at least forty-eight (48) hours' notice to cancel or reschedule.

Appointments canceled with less than forty-eight (48) hours' notice may be treated as late cancellations and may be subject to the applicable late cancellation fee. Failure to appear for a scheduled appointment without proper notice may be treated as a no-show and may be subject to the applicable no-show fee. The current late cancellation and no-show fee stated in the Patient Policies & Practice Agreement is seventy-five dollars ($75.00), subject to change in accordance with practice policy.

Late cancellations and missed appointments interfere with appointment availability and prevent the practice from offering those appointment times to other patients. Patients who repeatedly miss appointments, cancel late, arrive late, fail to meet payment obligations, or fail to comply with practice policies may be dismissed from the practice when appropriate and consistent with applicable law. Patients arriving late may have their appointment shortened, rescheduled, or otherwise handled in accordance with office policy.

10. Telehealth Requests and Services

Telehealth services are available only when clinically appropriate and permitted by applicable law. Telehealth appointments at Galleria Women's Health are generally available only for established patients. New patient appointments must generally be completed in person unless the practice determines otherwise in accordance with applicable law and clinical standards.

Patients must be physically located in the State of Nevada during a telehealth visit unless the practice expressly confirms otherwise in compliance with applicable law. By requesting or participating in a telehealth appointment, the patient represents and attests that the patient is physically located where the patient states they are located at the time of the visit.

Telehealth may not be appropriate for concerns requiring a physical examination, in-office testing, imaging, procedures, urgent evaluation, or emergency care. The provider may determine that an in-person evaluation is required. Telehealth does not guarantee a diagnosis, prescription, refill, referral, test order, or specific treatment plan.

Patients are responsible for using a private location, a reliable internet or telephone connection, and a device capable of supporting the visit. If technical problems occur, the practice may attempt to complete the visit by telephone when clinically appropriate. Recording any telehealth visit is prohibited unless all required parties have provided prior written consent or unless otherwise required by law.

11. Insurance, Payments, and Self-Pay Services

Insurance verification performed by Galleria Women's Health is provided only as a courtesy and is not a guarantee of payment, coverage, eligibility, or benefits. Insurance companies may provide incomplete or inaccurate benefit information, and final coverage determinations are made by the insurance carrier after claims are processed.

Patients are responsible for understanding their insurance benefits and for paying all amounts not paid by insurance, including deductibles, copayments, coinsurance, non-covered services, denied claims, self-pay services, elective services, deposits, fees, and remaining balances. Payment may be required before or at the time of service. Patients with outstanding balances may be required to satisfy those balances before additional appointments are scheduled.

Certain services, programs, laboratory tests, products, medications, supplements, or procedures may be self-pay, cash-pay, elective, wellness-based, or not covered by insurance. Galleria Women's Health does not guarantee that any appointment, test, procedure, medication, supplement, program, service, device, or treatment will be covered by insurance.

If online payment options are available, payments may be processed through third-party payment processors, patient portals, or practice management systems. By providing payment information, the patient authorizes Galleria Women's Health or its authorized payment processor to charge amounts owed in accordance with applicable practice policies, patient agreements, and law. Such amounts may include consultation fees, deposits, balances, self-pay charges, cancellation fees, no-show fees, administrative fees, and other amounts owed to the practice.

Refunds are issued only after an overpayment has been confirmed. Consultation fees are not refundable once services have been provided. Deposits collected for specific services may be non-refundable if the appointment is canceled late, missed, or otherwise subject to a non-refundable deposit policy. Refunds, credits, and account balances are handled in accordance with practice policy, payer rules, and applicable law.

12. Prescription Refill Requests

Prescription refill requests should be submitted through the patient portal unless the practice instructs otherwise. Refill requests are subject to provider review and are not guaranteed.

A prescription refill may require a follow-up appointment, updated medical history, laboratory testing, clinical evaluation, or additional monitoring. Controlled medications, hormone prescriptions, compounded medications, and other medications may require scheduled follow-up visits and provider approval.

Galleria Women's Health does not guarantee prescription refills through the Site, email, voicemail, social media, or general contact forms. Medications will not be prescribed or refilled when doing so is not clinically appropriate or when required follow-up care has not been completed.

13. Patient Portal, Website Forms, and Communications

Where available, the patient portal is the preferred method of communication for non-urgent patient matters. Website contact forms are intended only for administrative questions, appointment requests, and general inquiries.

Patients should not use website forms, regular email, voicemail, social media, or general online contact tools to submit urgent symptoms, emergency concerns, detailed medical questions, protected health information, prescription requests, or sensitive documents unless specifically directed by the practice.

Regular email may not be secure and is not the preferred method for medical communication. Submitting information through the Site does not guarantee immediate review or response. Galleria Women's Health is not responsible for delays caused by incomplete forms, incorrect contact information, technology issues, third-party platform problems, or messages sent through inappropriate channels.

14. Minor Patients

Use of the Site to request adult gynecologic, menopause, hormone, wellness, or related services is intended for adults or for parents or legal guardians acting on behalf of a minor patient, except where applicable law permits a minor to independently seek or consent to care.

Galleria Women's Health provides gynecologic care for adolescents and teens when medically appropriate. Minor patients should continue routine medical care with their pediatrician or primary care provider. The practice provides gynecologic and reproductive health services within its scope of practice.

Patients under eighteen (18) generally must be accompanied by a parent or legal guardian unless otherwise permitted or required by Nevada or federal law. The minor patient must be present for the visit. The practice cannot evaluate, diagnose, or provide medical advice about a child or minor who is not present. Confidentiality, consent, parental access, and communications involving minors will be handled in accordance with applicable law and clinical judgment.

15. Program and Service Information

Information on the Site regarding programs or services, including but not limited to menopause care, hormone-related care, functional medicine services, sexual wellness services, ultrasound appointments, and the MetaboLonge Program, is provided for general informational purposes only and does not constitute enrollment, acceptance as a patient, or a guarantee of eligibility.

Participation in any program or service may require clinical evaluation, provider approval, patient agreements, payment arrangements, follow-up visits, laboratory testing, monitoring, and compliance with practice policies. Repeated missed appointments, failure to complete required follow-up, failure to meet payment responsibilities, or failure to comply with program requirements may result in delays in care, prescription delays, discontinuation from a program, or dismissal from the practice when appropriate and consistent with applicable law.

16. Testimonials, Reviews, and Outcomes

Any testimonials, reviews, patient stories, or references to patient experiences appearing on the Site reflect individual experiences only. They do not constitute a guarantee, warranty, prediction, or representation that any other patient will have the same or similar result.

No treatment, program, medication, supplement, procedure, device, clinical approach, or wellness service can guarantee a specific outcome. Individual results vary based on medical history, age, genetics, symptoms, diagnosis, adherence, lifestyle, laboratory results, risk factors, contraindications, medications, and other individual circumstances.

Patient testimonials are published only with appropriate written authorization. Health-related information on the Site is intended to be truthful and educational, but it should not be interpreted as a promise, warranty, or guarantee of outcome.

17. Third-Party Links and Services

The Site may include links to or integrations with third-party websites, portals, scheduling systems, payment processors, social media platforms, video platforms, educational resources, or other external services that are not owned or controlled by Galleria Women's Health.

Third-party services are governed by their own terms, privacy policies, security practices, and user agreements. Galleria Women's Health does not control and is not responsible for third-party content, accuracy, availability, privacy practices, security, errors, outages, transactions, or damages arising from use of such third-party services.

A link to a third-party website or platform does not constitute an endorsement, sponsorship, approval, or assumption of responsibility by Galleria Women's Health.

18. Intellectual Property

All Content on the Site, including text, graphics, logos, images, videos, service descriptions, blog content, educational materials, downloadable resources, branding, design elements, page layouts, and other materials, is owned by or licensed to Galleria Women's Health unless otherwise stated.

Website Content may be viewed for personal, non-commercial, informational use only. No Content may be copied, reproduced, republished, modified, distributed, sold, scraped, framed, uploaded, transmitted, or used for commercial purposes without prior written permission from Galleria Women's Health.

The names, marks, logos, and branding associated with Galleria Women's Health may not be used in any manner that suggests endorsement, affiliation, sponsorship, or approval without prior written consent. Unauthorized use of Site Content may violate copyright, trademark, privacy, publicity, and other applicable laws.

19. Acceptable Use and Online Conduct

Users may not use the Site in any manner that violates applicable law, interferes with Site security or functionality, attempts to gain unauthorized access to systems or information, introduces malware or harmful code, misrepresents identity or contact information, submits false or misleading information, transmits abusive or harassing content, uses website forms for spam or solicitation, or attempts to copy, scrape, harvest, or misuse Site Content or user information.

Consistent with the practice's standards for a safe and respectful environment, abusive, threatening, harassing, discriminatory, or disruptive communications directed at providers, staff, patients, or others may result in restriction of access to online services, cancellation of appointments, dismissal from the practice, or other appropriate action consistent with applicable law.

Galleria Women's Health reserves the right to restrict, block, report, or take appropriate action against activity that appears unlawful, abusive, fraudulent, disruptive, harmful, or inconsistent with these Terms.

20. Privacy, HIPAA, and Accessibility

Galleria Women's Health maintains a separate Privacy Policy and a separate Notice of Privacy Practices. The Privacy Policy governs website-related privacy matters, including online forms, cookies, analytics, third-party tools, and general website data practices. The Notice of Privacy Practices governs the use and disclosure of protected health information under HIPAA and applicable privacy laws.

These Terms do not replace the Privacy Policy or the Notice of Privacy Practices. Users and patients should review those documents separately.

Galleria Women's Health strives to make the Site accessible and usable for patients and visitors. If a user has difficulty accessing any part of the Site, the user may contact the office and describe the issue, including the page involved and the browser, device, or assistive technology used, if applicable. The practice will make reasonable efforts to assist and improve access where possible. Some Site features may depend on third-party tools, plugins, portals, or embedded services that are not fully controlled by Galleria Women's Health.

21. Disclaimer of Warranties

THE SITE AND ALL SITE CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, GALLERIA WOMEN'S HEALTH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED ACCESS, AND ERROR-FREE OPERATION.

Nothing in this section is intended to alter the professional obligations applicable to medical care actually provided by Galleria Women's Health. Medical care, when provided, is governed by applicable professional standards, informed consent, patient-specific evaluation, and clinical judgment.

22. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GALLERIA WOMEN'S HEALTH, DEEPALI KASHYAP MD PLLC, AND THEIR OWNERS, PROVIDERS, EMPLOYEES, CONTRACTORS, AFFILIATES, VENDORS, WEBSITE DEVELOPERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO USE OF, OR INABILITY TO USE, THE SITE; RELIANCE ON SITE CONTENT; ERRORS, OMISSIONS, DELAYS, INTERRUPTIONS, OR TECHNICAL FAILURES; THIRD-PARTY WEBSITES OR PLATFORMS; UNAUTHORIZED ACCESS NOT CAUSED BY THE PRACTICE'S WILLFUL MISCONDUCT; MESSAGES SENT THROUGH INAPPROPRIATE OR NON-SECURE CHANNELS; OR FAILURE TO SEEK APPROPRIATE MEDICAL CARE.

Nothing in these Terms is intended to limit rights, remedies, duties, or liabilities that cannot be limited under applicable healthcare, privacy, consumer protection, professional liability, or other applicable laws.

23. Indemnification

To the extent permitted by applicable law, the user agrees to indemnify, defend, and hold harmless Galleria Women's Health, Deepali Kashyap MD PLLC, their owners, providers, employees, contractors, affiliates, vendors, and service providers from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to the user's misuse of the Site, violation of these Terms, submission of false or misleading information, unauthorized use of Site Content, infringement of third-party rights, or violation of applicable law.

This provision applies only to the extent permitted by law and shall not apply where prohibited by law.

24. Governing Law, Venue, and Severability

These Terms shall be governed by the laws of the State of Nevada and applicable federal law, without regard to conflict-of-law principles.

Any dispute arising from or related to Site use, Site Content, or these Terms shall be brought in the appropriate state or federal courts located in Clark County, Nevada, unless another venue is required by applicable law. Clinical care, billing, privacy, medical records, insurance, and patient-related matters may also be governed by applicable healthcare laws, insurance rules, patient agreements, informed consent documents, HIPAA, Nevada law, federal law, and other applicable legal requirements.

If any provision of these Terms is held invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid, unlawful, or unenforceable provision shall be limited or modified to the minimum extent necessary to make it valid and enforceable to the extent permitted by law.

25. Changes to These Terms

Galleria Women's Health may revise these Terms at any time. Updates may reflect changes in law, healthcare regulations, website functionality, practice operations, technology, insurance requirements, or clinical policies.

The updated version will be posted on the Site with a revised effective date or last updated date. Continued use of the Site after updated Terms are posted constitutes acceptance of the revised Terms. Users are encouraged to review these Terms periodically.
